If you would like to retain KFL&M to give you legal advice, act as your lawyers, or be your mediators, please contact our office and we would be pleased to discuss whether or not our firm can assist you.
Using this website, communicating with our staff via e-mail or phone, leaving voicemails, or submitting forms on our website will not make us your lawyers or mediators. You will not be considered a client of KFL&M until we have agreed to be your lawyers or mediators in accordance with our usual policies for accepting clients.
Until we agree in writing to give you legal advice, act as your lawyers, or be your mediators, please do not provide our office with any unsolicited confidential information or material. This information and material will not be treated as confidential by KFL&M, nor is it protected by solicitor-client privilege.

We can be your lawyers or mediators, but not both
Once we provide you with legal advice regarding a current or former spouse (or other opposing party), we cannot be the mediator for you and that spouse or opposing party. Likewise, if we have been mediators for you and your spouse or opposing party, we cannot act as your lawyer or give you legal advice. When you contact our office, please indicate if you want more information about our services: Mediation, Unbundled Service, Legal Coaching, and Representation in Court. We are happy to provide information about how we may be able to assist with your case.
Liability
Although KFL&M has made reasonable efforts to ensure that the materials contained on this site are accurate, it does not warrant or guarantee:

We recognize the importance of privacy, and the sensitivity of your personal information. For these reasons, we have created the following privacy policy. This policy outlines how we manage your personal information and how we safeguard your privacy. This policy is your guarantee that we will maintain the privacy and confidentiality of the personal information that you have given to us. We have trained our lawyers, mediators, and staff about the following policies and practices.
From January 1, 2004, all businesses engaged in commercial activities must comply with the provisions of the Personal Information and Electronic Documents Act (the “Act”, also known as PIPEDA), and the Canadian Standards Association Model Code for the protection of personal information. These obligations extend to Keleher Family Law & Mediation.
Why We Collect Personal Information
Keleher Family Law & Mediation collects personal information for the following limited reasons:
- To properly assist you as our client;
- To establish and maintain client lists; and
- For internal purposes, including the professional development of staff.
What Personal Information Do We Collect?
Personal information is any information that identifies you, or by which your identity could be deduced. We collect and use your personal information in order to provide you with legal or mediation services, but we only retain the information necessary for these purposes. We are committed to collecting personal information in a fair, open and lawful manner. Wherever possible, we collect your personal information directly from you at the start of a file and in the course of our retained relationship.
Implied consent to collect and use your personal information
In some cases, we will ask you to expressly consent if we collect, use, or disclose your personal information. Other times, your consent may be implied through your conduct with us. For example, if you complete a form that is on our website and send it to us, or if you provide information about your case to our staff, your consent to collect and use that information, in accordance with the terms of this policy, is implied. And we will imply your consent to share your personal information with those who you advise us are your agents, unless you advise us otherwise in writing.
Use of Your Information
By retaining our firm, you have confirmed your trust in us. We are honoured by this trust and take pride in serving you.
We use your personal information to provide services to you and to administer our client (time and billing) databases. We are obligated to retain our client files after the end of the retainer for a period of several years. Prior to storing your file, we will return all of your original personal documents to you.
Our firm stores and maintains personal information in accordance with the PIPEDA requirements. We do not disclose your personal information to any third party tenable them to market their products and services.
When We Do Disclose Personal Information
We may disclose your personal information under the following limited circumstances:
- When you have consented to the disclosure, actually or by implication;
- When we are required or authorized by law to do so (e.g. if a court issues a subpoena);
- When the services we are providing to you require us to give your information to third parties (e.g. when other professionals are retained by you or by us to assist with your mediation or litigation), your consent will be implied, unless you tell us otherwise;
- When it is necessary to establish or collect fees;
- If we engage expert witnesses on your behalf;
- For the purpose of training staff;
- If we engage a third party to provide administrative services to us (like computer backup services or archival file storage) and the third party is bound by our privacy policy; or
- If the information is already publicly known.
Security of Personal Information
Our firm has implemented security safeguards appropriate to the sensitivity of the personal information we keep. We take all reasonable precautions to ensure that your personal information is secure and kept safe from unauthorized access, loss, modification or disclosure. These precautions include:
- Restricted file access to personal information;
- deploying technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access;
- Internal password and security policies; and
- Premises security.
We ensure that any of our staff who deal with personal information are properly trained and are aware of the necessary and appropriate measures required to protect your personal information.
Accuracy
We are committed to maintaining accurate, complete and up-to-date personal information. This begins with you. If you are aware of any changes to the personal information you have given to us, kindly inform us of the changes so that we may update our records accordingly.
We Are Accessible to You
Information about our policies and practices regarding the collection and maintenance of personal information is available to all interested parties.
